Within the past years, the European Union citizenship, established 1992 in the frame of the Maastricht Treaty, has developed into an institution of a meaning which the contracting parties have certainly not foreseen. The European Court of Justice has made Art. 18 ECT the base of a General Freedom of Movement Act which is applied to measures that affect the exercise of the respective liberty. Eventually, the European Union citizenship in combination with a general prohibition of discriminatory practices results in a right to equal treatment which most of all deploys its meaning within the social legislation. The present work indicates the enormous practical pertinence of this jurisdiction widely exceeds the respective judicial field. The author analyzes the enacted jurisdiction in an overall context and offers a dogmatic integration. The work's core is constituted by reflections as to the European Union citizen's Freedom of Movement Act and the prohibition of restraint included therein as well as the limits of the right of residence and the right to equal treatment within the social law. The author completes her work by addressing the issue of the jurisdiction's theoretic-constitutional dimensions.
